Tigeraire, a company specializing in cooling products for athletes, has filed a notice of opposition with the U.S. Patent and Trademark Office against Tiger Woods’ Sun Day Red logo. They claim that Woods and his team have unlawfully used Tigeraire’s design in their branding, leading to consumer confusion.
This dispute comes after the launch of Sun Day Red in May, which pays tribute to Woods’ iconic Sunday red attire and his 15 major championships. The brand has been well received in the North American marketplace, according to TaylorMade CEO David Abeles.
Despite the legal hurdle, TaylorMade Golf expressed confidence in the securitization of their trademarks. Woods and his team have 40 days to respond to the notice of opposition, and legal experts believe that the case is likely to settle before going to trial.
Trademark attorney Josh Gerben stated, “By filing this opposition, the portable fan company really basically gets them a seat at the table to negotiate. Because in order for Tiger and TaylorMade to get this trademark registered there, you’re gonna have to win this case.”
